Terms of Use

1. Publisher
The GhostTrace mobile application ("the App") and the website ghosttracefpv.com are published by Naka-Tek, a French simplified joint-stock company (SAS) with share capital of €500, registered with the Paris Trade and Companies Register under SIREN 848 613 139, headquartered at 128 rue La Boétie, 75008 Paris, France. Director of publication: Karim Fadli.
2. Acceptance
By installing, accessing or using the App, you accept these Terms of Use without reservation. If you do not accept, do not install or use the App. These Terms govern the relationship between you and Naka-Tek concerning the App and any related cloud service.
3. License & ownership
Naka-Tek grants you a free, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own non-commercial purposes. You may not redistribute, decompile, reverse-engineer, sub-license or resell the App, except to the extent expressly permitted by applicable law. All intellectual-property rights in the App, the brand "GhostTrace", the logo, the source code and the related content remain the exclusive property of Naka-Tek.
4. Account & guest mode
The App can be used in guest mode (no account, no cloud sync) or with a free account. To create an account, you provide an email and a password, or you sign in with Google. You are responsible for keeping your credentials confidential and for all activity under your account. We reserve the right to suspend or terminate any account that abuses the service, attempts to circumvent security, or violates applicable laws.
5. User responsibility — drone safety
You are solely responsible for the safe operation of your drone, compliance with local aviation regulations (notably the European Union's Regulation (EU) 2019/947 for "open" / "specific" / "certified" categories), declarations to your national civil aviation authority, third-party safety, privacy of overflown areas, and the accuracy of the data you record or import. The App is a logging and analysis tool — it does not pilot your aircraft and is not a flight-control system.
6. Your data, your ownership
Telemetry, flight sessions, drone specifications and pilot stats you create or import remain your property. Naka-Tek does not claim any ownership over your flight data. We process this data only as required to provide the service (see the Privacy Policy).
7. Service availability — beta status
The App is currently in beta. We make commercially reasonable efforts to keep the service available, but we do not guarantee uninterrupted, error-free or bug-free operation. Features may change, be removed or be added without prior notice. Scheduled maintenance and incidents may temporarily restrict access.
8. No warranty
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranty of any kind, express or implied — including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant the accuracy of telemetry parsing, blackbox decoding, GPS extraction, or any statistical computation. Any decision based on App data is your own.
9. Limitation of liability
To the maximum extent permitted by applicable law, Naka-Tek and its directors, employees and partners shall not be liable for any indirect, incidental, special or consequential damages, loss of profit, loss of data, drone crashes, regulatory issues, third-party actions, or service interruption, even if Naka-Tek has been advised of the possibility of such damages. In any case, our aggregate liability shall be limited to fifty (50) euros — an amount the parties agree is appropriate given that the App is provided free of charge.
10. Changes to these terms
We may update these Terms of Use at any time. The "Last updated" date above will be updated, and material changes will be communicated in-app. Continued use of the App after the effective date of the new terms constitutes acceptance.
11. Termination
You may stop using the App and delete your account at any time from the in-app Profile screen. Naka-Tek may suspend or terminate access to the App for material breach of these Terms or applicable law, with reasonable notice unless safety or security requires immediate action.
12. Governing law & jurisdiction
These Terms are governed by French law. Any dispute that cannot be resolved amicably will be brought before the competent courts of Paris (France), without prejudice to the consumer's right under European law to bring action before the courts of their domicile.
